This Legal Disclaimer governs your access to and use of the website www.cavalier.in, the Cavalier mobile application, and any related services, content, courses, study material or platforms operated by The Cavalier (collectively, the "Service"). By accessing or using the Service, you expressly understand and agree to the terms set out below. If you do not agree, you must discontinue use of the Service immediately.
1. Service Provided "As Is"
Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis.
The Cavalier expressly disclaims all warranties of any kind, whether express, implied, statutory or otherwise, including but not limited to:
- The implied warranties of merchantability;
- Fitness for a particular purpose;
- Title and non-infringement;
- Any warranties arising out of course of dealing or usage of trade.
2. No Warranty of Performance
The Cavalier makes no warranty that:
- The Service will meet your requirements or expectations;
- The Service will be uninterrupted, timely, secure or error-free;
- The results that may be obtained from the use of the Service will be accurate or reliable;
- The quality of any products, services, information or other material purchased or obtained by you through the Service will meet your expectations;
- Any errors in the software, mobile application or website will be corrected;
- The Service, the servers that make it available, or any communications sent through it are free of viruses or other harmful components.
3. Downloads and User Devices
Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk. You will be solely responsible for any damage to your computer system, mobile device, or loss of data that results from the download or use of any such material.
No advice or information, whether oral or written, obtained by you from The Cavalier or through the Service shall create any warranty not expressly stated in these terms.
4. No Guarantee of Examination Results or Career Outcomes
The Cavalier provides coaching, study material, mock tests, mentorship and SSB orientation as preparatory aids only. Selection in any defence examination — including but not limited to NDA, CDS, AFCAT, CAPF, ACC, TES, Coast Guard AC, SSB and any associated written or interview process — depends entirely on the candidate's individual effort, performance, eligibility, medical fitness and decisions taken by the conducting authority (UPSC, the Services Selection Board, the Indian Armed Forces, or other governmental body).
The Cavalier does not guarantee, promise or assure selection, recommendation, merit ranking, written exam clearance, SSB recommendation, joining, commission or any other career outcome. Past selection records, success stories, testimonials or statistics published on the Service are illustrative of historical performance only and are not a representation, projection or warranty of future results for any individual candidate.
5. Educational Content — General Information Only
All content on the Service — including study material, notes, articles, blog posts, video lectures, current affairs, previous-year question papers and answer keys — is provided for general informational and preparatory purposes only. While The Cavalier endeavours to maintain accuracy and relevance, content is not a substitute for the official syllabus, notification or instructions issued by the conducting authority.
You are solely responsible for verifying eligibility, exam dates, syllabus, age limits, medical standards and any other requirements directly from the official sources before relying on information provided through the Service.
6. Third-Party Content and Links
The Service may contain links to third-party websites, advertisements, content or services that are not owned or controlled by The Cavalier. The Cavalier has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party site or service. The inclusion of any link does not imply endorsement.
Any reliance you place on third-party content, including testimonials authored by users, is at your own risk.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall The Cavalier, its parent company DEFTIRO VENTURES, its directors, faculty, employees, agents, partners or affiliates be liable to you for any:
direct, indirect, incidental, special, consequential, exemplary or punitive damages — including but not limited to damages for loss of profits, goodwill, examination opportunity, career advancement, data, use or other intangible losses — resulting from or arising out of your use of, or inability to use, the Service, or from any content obtained through the Service.
If, despite the foregoing limitation, The Cavalier is found liable to you for any damage or loss arising from or connected with the use of the Service, the total aggregate liability of The Cavalier shall not exceed the amount, if any, paid by you to The Cavalier for the specific course or service that gave rise to the claim, in the twelve (12) months immediately preceding the event giving rise to the claim.
8. Indemnity
You agree to indemnify, defend and hold harmless The Cavalier, DEFTIRO VENTURES, its directors, faculty, employees, agents, partners and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs and expenses — including reasonable legal fees — arising out of or in connection with:
- Your access to or use of the Service;
- Your violation of these terms or any applicable law;
- Your infringement of any intellectual property right or other right of any third party;
- Any content, data or material you submit, post or transmit through the Service.
9. Force Majeure
The Cavalier shall not be liable for any failure or delay in performance of the Service caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government action, restrictions imposed by State or Central Government, war, civil unrest, strikes, internet outages, server downtime, power failures, or failures of third-party service providers.
10. Changes to the Service
The Cavalier reserves the right at any time, and from time to time, to modify, suspend or discontinue, temporarily or permanently, the Service or any part of it, with or without notice. The Cavalier shall not be liable to you or any third party for any such modification, suspension or discontinuance.
11. Governing Law and Jurisdiction
This Legal Disclaimer is governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with this Disclaimer, the Service, or your use of the Service shall be subject to the exclusive jurisdiction of the courts at New Delhi.
12. Severability
If any provision of this Legal Disclaimer is held by a court of competent jurisdiction to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired. The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original.
13. Entire Agreement
This Legal Disclaimer, together with the Terms & Conditions, Privacy Policy and Refund Policy, constitutes the entire agreement between you and The Cavalier with respect to the Service and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
